EMERGENCY DECLARATION FOR PARKSIDE BOROUGH, DELAWARE COUNTY, PENNSYLVANIA DUE TO THE IMMINENT CLOSURE OF THE CROZER HEALTH SYSTEM AND THE CHAPTER 11 BANKRUPTCY FILING BY PROSPECT MEDICAL HOLDINGS, THE PARENT COMPANY OF CROZER HEALTH
WHEREAS, pursuant to the authority vested by 35 Pa. C.S.A. §7501(b) and PA Borough Code Section 1006-A(b), the Mayor is authorized to declare emergencies because of the severe effects on healthcare and emergency services within Parkside Borough and throughout Delaware County anticipated by the imminent closure of the Crozer Health System, and the Chapter 11 bankruptcy filing by Prospect Medical Holdings, the parent company of Crozer Health; and
WHEREAS, the Borough of Parkside wishes to mitigate the adverse effects on healthcare and emergency services of both Parkside Borough and the Parkside Borough Fire Department; and
WHEREAS, the Borough intends to activate the response and recovery aspects of all applicable local emergency management plans and to authorize the furnishing of aid and assistance to its citizens, where necessary, thereunder; and
WHEREAS, the declaration of an emergency authorizes the Borough to enter into contracts and incur obligations necessary to disaster emergency management, response and recovery; and
WHEREAS, the declaration of an emergency further authorizes the Borough to exercise certain powers vested under 35 Pa. C.S.A. §7501 et seq. without regard to time-consuming procedures and formalities prescribed by law pertaining to the performance of public work, entering into contracts, the incurring of obligations, the employment of temporary workers, the rental of equipment, the purchase of supplies and materials, and the levying of taxes and the appropriation and expenditure of public funds.
NOW THEREFORE, IT IS HEREBY DECLARED, by the Mayor of the Borough of Parkside, County of Delaware, Pennsylvania, that:
The adverse effects on healthcare and emergency services in the Borough due to the imminent closure of the Crozer Health System constitute a clear and present danger to life or property.
The Disaster Emergency declared for the Borough under 35 Pa. C.S.A. §7501(b) and PA Borough Code Section 1006-A(b) by the Mayor and the resulting enabling provisions of 35 Pa. C.S.A. §7501 shall continue until further action is taken by the Mayor or the Borough Council to declare the end of such Disaster Emergency.
